Guest registration in Spain: SES Hospedajes, a guide for hosts
This page summarises Real Decreto 933/2021 for someone who lets a place in Spain. MyStay does not send the reports to SES.HOSPEDAJES and does not automate that registration.
The rule
Real Decreto 933/2021, of 26 October, was published in the BOE on 27 October 2021. It applies across Spain to lodging and to driverless vehicle rental, whatever the form of the business. The Interior Ministry’s questions say it covers people who lodge guests professionally or not, and people who act as intermediaries.
Check-in forms
Article 4 says the host collects the guest’s data on a check-in form. Anyone over 14 signs their own form. For a guest under 14, the accompanying adult provides the data. The host is responsible for the accuracy of what is written down, against the identity document the guest shows.
The register, and who is exempt from it
Article 5 requires a computer register of the data in the decree’s annexes, kept for three years from the end of the stay. Article 5.4 exempts hosts who do not lodge professionally from that register and from that retention. They still have the communication duties in article 6. The ministry’s questions say the same thing in shorter form: a private host has the communication duties in article 6.
What to send, and when
Article 6.3 says the reservation, the contract, a cancellation, and the start of the service are sent immediately, and in any case within 24 hours of each of those moments. Article 6.4 says the communication is telematic. A host who does not lodge professionally may use a non-telematic method, by the procedure that is set. This page does not describe that procedure. It is in the decree and in what the ministry publishes.
The ministry’s questions also describe fines under the citizen-security law: 100 to 600 euros for a minor breach, such as late or incomplete data, and 601 to 30,000 euros for a serious breach, such as not registering as a lodging provider or not sending the guest data. Those ranges are the ministry’s, not an estimate.
Where the host does it
The ministry points hosts to SES.HOSPEDAJES on its electronic office. The tourist-rental registration number is a different step: the same ministry page says that number comes from the Ministry of Housing and Urban Agenda.
What MyStay does
MyStay does not file parts with SES.HOSPEDAJES and does not automate guest registration. The host does that on the ministry’s site. A booking page does not replace it.
